Acceptance of terms

By accessing or using Brand Machine ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. Brand Machine is operated by Digital Arts Institute ("we", "us").

Use of the platform

Brand Machine helps you create, localize, schedule, and publish content across social media channels. You may use the Platform only in accordance with these Terms and all applicable laws. You are responsible for maintaining the confidentiality of your account credentials.

User responsibility for content

You retain ownership of all content you upload, generate, or publish through Brand Machine. You are solely responsible for that content, including ensuring you have all rights, licenses, and permissions necessary to publish it, and that it complies with the rules of every platform on which it is published.

You grant Brand Machine a limited license to store, process, translate, format, and transmit your content solely to provide the service to you.

Connected social media accounts

When you connect a Facebook, Instagram, TikTok, LinkedIn, YouTube, or other account, you authorize Brand Machine to act on your behalf within the scopes you grant. You remain bound by the terms of each connected platform, and you are responsible for any content published through your connected accounts. You may disconnect any account at any time.

Acceptable use

You agree not to use Brand Machine to:

  • publish unlawful, infringing, deceptive, harassing, or harmful content;
  • impersonate any person or misrepresent your affiliation;
  • send spam or violate the policies of any connected social platform;
  • attempt to access, probe, or disrupt the Platform or other users;
  • reverse engineer, resell, or sublicense the Platform without written consent.

We may remove content or restrict accounts that violate these rules.

Subscriptions and paid services

Brand Machine may offer free and paid plans. If paid subscriptions are introduced, fees, billing cycles, and renewal terms will be presented at checkout and become part of these Terms. Unless required by law, fees are non-refundable. We may change pricing with reasonable advance notice.

Service availability

We work to keep the Platform available and reliable, but we do not guarantee uninterrupted access. Features may change, and connected social platforms may modify or restrict their APIs, which can affect functionality.

Limitation of liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Digital Arts Institute is not liable for any indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Platform. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred euros, whichever is greater.

Termination

You may stop using Brand Machine at any time and request account deletion by emailing us. We may suspend or terminate your access if you violate these Terms, misuse the Platform, or create risk for us or other users. On termination, your right to use the Platform ends, and we will delete your data in accordance with our Privacy Policy.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of Brand Machine after changes take effect constitutes acceptance of the updated Terms.
